Privacy Policy

Millwrights Local 2736 is committed to ensuring the privacy of its members and maintaining the accuracy and security of each member's personal information. As such we have developed this Privacy Policy and have appointed a Privacy Officer whose duties will include ensuring Millwrights Local 2736 is in compliance with the policy. Please note that Millwrights Local 2736 may, from time to time, modify this Privacy Policy to reflect legal, technical and other developments. In that event such changes will be communicated to our members.

Please take the time to read this policy carefully so as to be assured that Millwrights Local 2736 takes your privacy seriously and will protect the information we have about you to the fullest extent of the law.

Collection of Personal Information

Personal information is information that refers to you specifically. With your consent, we may gather personal information from you in person, by telephone or by corresponding with you via mail or the Internet. We will also receive personal information about you from your employer(s) regarding hours of work, rates of pay, dues, health and welfare benefits and/or other information in regard to your employment.

The type of information that we usually collect and maintain in our files may include your:

  • Name
  • Mailing Address
  • E-mail Address
  • Phone, cell and/or pager numbers
  • Social Insurance Number
  • Date of Birth
  • Work History
  • Earnings, health and welfare information, pension
  • Journeyman ticket
  • Other qualifications
  • Discipline records
  • Contact person in case of emergency
  • Training
  • Apprenticeship records

Personal information is collected in order to carry on the business of the union which includes establishing working conditions, organizing, administrating collective agreements and servicing our members.

Consent and Disclosure of Personal Information

Information regarding members classifications, work availability, eligibility and contact information may be disclosed to third parties for the purposes of establishing work opportunities on the members' behalf. In providing Millwrights Local 2736 with this information you are consenting to the disclosure of this information for the purposes mentioned. In addition, Millwrights Local 2736 may disclose the information to third parties when required by law or when the law has deemed that consent has been given.

It is your responsibility to ensure that the information you provide us is accurate. In particular, qualifications should be examined to ensure that you will be considered for dispatch for jobs requiring certain qualifications. Millwrights Local 2736 will not be responsible for any loss or damage resulting from such personal information disclosed at the option of the member.

Member information may only be used or disclosed for the purpose for which it was collected unless the member has otherwise consented or when it is required or permitted by law. While Millwrights Local 2736 will employ appropriate procedures to help ensure that members' information is only used for authorized purposes Millwrights Local 2736 cannot make any guarantees with respect to the actions of such third parties.

Member information may only be retained for the period of time to fulfill the purpose for which it was collected. In any case when Millwrights Local 2736 makes a decision that effects you personally any personal information in regards to this decision in the possession of Millwrights Local 2736 will be kept for at least one year.

Withdrawal of Consent

Subject to contractual or legal restrictions you may withdraw your consent to the use and disclosure of the personal information at any time. A withdrawal of consent to the disclosure of the information will essentially prevent Millwrights Local 2736 from helping to establish work opportunities or training for you. In particular, we will not be able to dispatch you to jobs.

Security

Appropriate safeguards will be implemented to prevent personal information from unauthorized use and access in an effort to ensure the security, integrity and privacy of personal information.

Access to Personal Information

Upon request a member shall be informed of the existence, use and disclosure of their personal information and shall be given access to it. Members may verify the accuracy and completeness of their information and may request that it be amended, if necessary. It is the members' responsibility to ensure personal information provided is complete and up-to-date. The procedures of the review may not compromise the security, integrity or privacy of other members' information.

Millwrights Local 2736 has the right to refuse such a request in certain situations. These situations include:

  • When the information is protected by the solicitor-client privileges
  • Where the disclosure would reveal confidential information that could harm the competitive position of the organization
  • Where the disclosure could threaten the safety or health of an individual whether it be individual making the request or another person
  • The disclosure would reveal personal information about another individual
  • Where the information is generated for the purpose of a mediation/arbitration hearing

Millwrights Local 2736 is committed to making information available to members concerning the policies and practices that apply to the management of their information.

Notice Pursuant to the Personal Information Protection Act

The Millwrights Local 2736 acts as the bargaining agent for the employees in construction and other industries throughout the Province of British Columbia. As the bargaining agent Millwrights Local 2736 has a legal duty to represent its membership in employment, collective agreement administration and collective bargaining matters. When you apply to become a member of Millwrights Local 2736 or you accept employment with an employer who is signatory to a Millwright Local 2736 collective agreement either the Millwright Local 2736 or the employer will be obtaining personal information which may include your name, address, telephone number, social insurance number, date of birth, work history/qualifications, earnings, RRSP account numbers and information relevant to the administration of the health and welfare plan where it reasonably relates to your employment.

The purpose for collecting this information will include but may not be limited to:

  • The union's duty to administer the collective bargaining agreement
  • To represent you and other members in the bargaining unit in issues arising out of the administration of the collective agreement or collective bargaining
  • Obtaining employment for you and other members of the bargaining unit
  • Representing the interests of the union and the members generally with respect to collective bargaining between Millwrights Local 2736 and employers in an industry with a collective bargaining relationship with the Millwrights Local 2736
  • Proceeding with the investigation, mediation, litigation or settlement of any disputes or issues which may exist between the local union and the employers on behalf of its members including grievances, arbitrations, Labour Relations Board hearings, government appointed inquiry commissions and other legal or administrative proceedings

The information that the Millwrights Local 2736 collects may be disclosed in whole or in part depending on the circumstances to:

  • Other staff of Millwrights Local 2736 or its accounts or legal advisors
  • To prospective employers
  • To elected officials of Millwrights Local 2736
  • To official representatives of your employer or former employers as may be required in the circumstances
  • When required by law
  • In situations where you specifically agree that the information can be disclosed
